I think it's realistic to say that Duke4Ever will be released after all IP rights have been settled. Take Two Interactive who owned the publishing right can still make fucling loads of cash if they managed to release the game, even after all this mess. There are still loads of fans and customers loyal to the Duke franchise and many i have spoke to says they will buy/play the game in any case by pure curiosity.

So, right now they have to settle all the rights, who is legally permitted to pick up and finish the work, how much of the actual work can be re-used for further work, who will get the cash in the end ect.

A bureaucratic mess that takes time since there is so much money to be made of this.

Hehe that's a pretty sweet video of the game that will never be, and was never meant to be.

But all those comments that Duke makes, gave me an idea - whatif somebody made a game where the main character was just as chatty, but he was a VERY reluctant hero? So in contrast to Duke's "come get some" and laughter every time you frag an octabrain, the reluctant hero would be full of "OH GOD WHAT HAVE I DONE"s, "I'm so sorry! I had no choice"s, "If only there were some other way"s, "Why can't we all just get along?"s and miserable weeping and gazing in horror at your bloodstained hands every time you look at a corpse of your fallen foe.

That way, the game's character can bear the burden of conscience, freeing up the player to revel in an orgy of guilt-free destruction, like what first person shooters want them to do anyway.
